Poketerminal ("Poketerminal," "we," "us") operates the website at poketerminal.io (the "Website") and the Poketerminal mobile application (the "App"). The Website, App, and related products and features are collectively the "Services." Your use of the Services is governed by these Terms of Service (these "Terms").

Please read these Terms carefully. By accessing, downloading, installing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

We may change these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If we make material changes, we will provide at least thirty (30) days' advance notice where practicable and where required by law. Your continued use after the effective date of updated Terms constitutes acceptance of those changes.

1. The Services

  • Poketerminal provides tools and information for Pokémon collectors, investors, and sellers—including portfolio tracking, market data, alerts, scanning, and features that may help you coordinate with other users or businesses. We work to keep the Services reliable and secure, and we may modify, suspend, or discontinue features where permitted by law.
  • Certain features may require you to create an account ("Account"). You must provide accurate information and keep it current. You are responsible for activity under your Account and for safeguarding credentials. Notify us promptly of unauthorized use.
  • You may stop using the Services or delete your Account where the product allows. Some obligations and rights survive termination (see below).
  • If you choose a username or similar identifier, we may change or remove it if we reasonably believe it is necessary (for example to address impersonation or infringement).

2. Privacy and cookies

By using the Services, you consent to our collection, use, and disclosure of personal information as described in our Privacy Policy. The Website may use cookies and similar technologies as explained there. If you disable cookies, some Website features may not work properly.

3. Promotional content

The Services may include promotional surfaces, upgrade prompts, or information about plans and partners. Unless we state otherwise, such content is for general information and does not constitute an offer where prohibited.

4. Eligibility and your obligations

You may not use the Services if:

  • you are not old enough to form a binding contract or meet the minimum age required by applicable law for the Services (typically at least 13, or higher where local law requires parental consent);
  • you are prohibited from using the Services under applicable law;
  • we have previously terminated your Account for serious or repeated violations of these Terms or our policies; or
  • you are using the Services on behalf of another person without their permission.

You will comply with all applicable laws and these Terms. You will not misuse the Services, attempt to access them by unauthorized means, or interfere with their operation.

5. User content and community standards

The Services may allow you to submit, post, or transmit content such as text, images, listings, or messages ("User Content"). You retain ownership of your User Content, subject to the license you grant below.

Without limiting other rules, you agree that User Content and your use of the Services will not:

  • violate any applicable law or third-party rights (including IP and privacy rights);
  • include unlawful, harassing, hateful, discriminatory, violent, or sexually explicit material, or content that exploits or harms minors;
  • include malware, spam, or deceptive or fraudulent schemes;
  • impersonate Poketerminal, another user, or any person or entity, or misrepresent affiliation, identity, inventory, or the condition or authenticity of items;
  • scrape, crawl, or harvest the Services in violation of our rules or applicable law, or attempt to bypass security or rate limits;
  • transmit worms, viruses, or destructive code, or interfere with others' enjoyment of the Services; or
  • use the Services for illegal gambling, money laundering, or other unlawful activity.

We are not obligated to monitor User Content but may review, remove, or restrict content or suspend Accounts to protect users, comply with law, or enforce these Terms.

6. License you grant to us

To operate the Services, you grant Poketerminal a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, and distribute your User Content solely to provide, improve, promote, and secure the Services. You represent that you have the rights needed to grant this license. You may delete certain User Content where the product allows; residual copies may persist for a limited period in backups.

7. Trades, sales, and dealings between users

Parts of the Services may help you communicate, list items, reserve inventory, or otherwise coordinate transactions that occur directly between you and other users or businesses. Unless we explicitly agree in writing for a specific transaction, Poketerminal is not a party to those deals. We are a technology platform that may facilitate introductions or logistics—not the buyer, seller, broker, insurer, escrow agent, or guarantor.

You are solely responsible for evaluating counterparties, negotiating terms, inspecting items, paying taxes, complying with shipping and import rules, and resolving disputes. In-person meetings are at your own risk. Nothing in the Services is financial, tax, or legal advice; market information is informational only.

8. Account suspension, content removal, and termination

We may suspend or terminate access to the Services, remove or refuse to host User Content, or take legal action if we reasonably believe you violated these Terms, created risk or legal exposure for us or others, or where required by law. Where practicable, we will provide notice before suspension or termination unless immediate action is needed for safety, security, or legal reasons.

Provisions that by their nature should survive (including licenses where needed to operate residual copies, disclaimers, limitations of liability, indemnity, and dispute terms) survive termination.

9. Camera, scanning, and images

Features that use your device camera (for example card scanning) require your permission. You are responsible for the images you capture and for ensuring you have the right to submit them. You may not use scanning features in a way that infringes third-party rights. We may modify or discontinue scanning features over time.

10. Intellectual property

The Services, branding, software, and related materials are owned by Poketerminal or its licensors and are protected by intellectual property laws. Except for your User Content, you may not copy, modify, distribute, sell, or reverse engineer the Services except as permitted by law.

Poketerminal is an independent platform and is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, GAME FREAK, Creatures Inc., Wizards of the Coast, or other rights holders. Pokémon and related marks are trademarks of their respective owners.

Where the Services display catalog information, card images, set symbols, or similar assets from licensors, partners, or the community, those materials remain the property of their respective owners (for example, official English-language card artwork may be owned by The Pokémon Company International). Your use of the Services does not grant you a license to reproduce or redistribute third-party materials except as permitted by applicable law or the applicable rights holder’s terms.

11. Third-party services and data

The Services may integrate third-party APIs, maps, stores, payment processors, and data sources. Those third parties have their own terms and policies. We are not responsible for third-party services, delays, errors, or availability.

References to marketplaces or pricing sources (for example eBay, TCGplayer, or Fanatics Collect) are for identification and context only. Poketerminal is not affiliated with, sponsored by, or endorsed by those companies, and their names and marks belong to their respective owners.

Guide values, charts, and related market figures may combine public marketplace data with Poketerminal catalog snapshots and other verified public sources. We refresh data on a schedule; displayed prices and trends are estimates for research and negotiation, not offers to buy or sell.

References to grading companies or grade labels (for example PSA, BGS, CGC, TAG, or SGC) are for identification and context only. Poketerminal is not affiliated with, sponsored by, or endorsed by those companies, and does not submit cards for certification on your behalf.

12. Subscriptions, fees, and trials

Paid plans or add-ons, when offered, may be billed through platform providers (such as Apple or Google) or other checkout flows we specify. Fees, renewals, cancellations, and refunds are governed by the applicable store policies and any purchase terms we present. Free tiers and development builds may differ from production entitlements.

13. Disclaimers; limitation of liability

The Services and all content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation or that market data or third-party content is accurate or complete.

To the fullest extent permitted by applicable law, Poketerminal and its affiliates, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, data, or other intangible losses, arising out of or related to your use of the Services or any interactions or transactions between you and other users or third parties—including disputes over authenticity, condition, delivery, payment, or performance—even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our aggregate liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amounts you paid to Poketerminal for the Services in the twelve (12) months before the claim or (b) one hundred U.S. dollars (US$100), except where liability cannot be limited under applicable law.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

14. Indemnity

You will defend, indemnify, and hold harmless Poketerminal and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Services, your violation of these Terms, or your interactions or transactions with other users or third parties.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except that mandatory consumer protections where you live may also apply. Except where prohibited, you and Poketerminal agree that any dispute arising out of these Terms or the Services will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there. You waive any right to participate in a class-action lawsuit or class-wide arbitration against Poketerminal where such waiver is enforceable.

If you are a consumer in a jurisdiction that does not permit forum selection or class waivers, those parts may not apply to you.

16. General

  • Assignment. You may not assign these Terms without our consent. We may assign our rights and obligations as part of a merger, acquisition, or sale of assets.
  • Notices. We may provide notices via the Services, email associated with your Account, or the Website.
  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Poketerminal regarding the Services (subject to additional terms presented at purchase where applicable).
  • Severability. If any provision is held invalid, the remainder remains in effect to the fullest extent permitted.
