Terms of Service

These Terms govern your use of poketerminal.io, the Poketerminal app, and related features (the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

We may update these Terms. We will post changes here and update the date above. Material changes get at least thirty (30) days' notice where practicable and required. Continued use after the effective date means you accept the update.

1. Services and accounts

Poketerminal provides tools for collectors, investors, and sellers: portfolio tracking, market data, alerts, scanning, and features to coordinate with other users or businesses. We may modify, suspend, or discontinue features where permitted by law.

Some features require an Account. Keep your information accurate and credentials secure. You are responsible for activity under your Account. Notify us of unauthorized use. You may delete your Account where the product allows. We may change or remove usernames that pose impersonation or infringement risk.

2. Privacy

Your use is also governed by our Privacy Policy, including cookies on the Website.

3. Eligibility

You may not use the Services if you:

  • are under the age to form a binding contract (typically at least 13, or higher where local law requires parental consent);
  • are barred by applicable law;
  • were terminated for serious or repeated violations; or
  • use the Services for someone else without permission.

You will comply with applicable law and these Terms. Do not misuse the Services or interfere with their operation.

4. User content

You may submit content such as text, images, listings, or messages ("User Content"). You keep ownership, subject to the license below. User Content and your use of the Services must not:

  • violate law or third-party rights (including IP and privacy);
  • include unlawful, harassing, hateful, violent, sexually explicit, or minor-exploiting material;
  • include malware, spam, or fraud;
  • impersonate others or misrepresent items, inventory, or authenticity;
  • scrape or bypass security or rate limits unlawfully;
  • transmit destructive code or interfere with others; or
  • support illegal gambling, money laundering, or other unlawful activity.

We may review, remove, or restrict content and suspend Accounts to protect users, comply with law, or enforce these Terms. We are not obligated to monitor all User Content.

5. License to Poketerminal

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, and distribute your User Content solely to provide, improve, promote, and secure the Services. You represent you have the rights to grant this license. Residual copies may persist briefly in backups after deletion.

6. Deals between users

The Services may help you list items, message others, or coordinate transactions directly between you and other users or businesses. Unless we agree in writing for a specific transaction, Poketerminal is not a party to those deals. We are a technology platform, not the buyer, seller, broker, insurer, escrow agent, or guarantor.

You are solely responsible for evaluating counterparties, negotiating terms, inspecting items, paying taxes, complying with shipping and import rules, and resolving disputes. In-person meetings are at your own risk. Market information is informational only, not financial, tax, or legal advice.

7. Suspension and termination

We may suspend or terminate access, remove content, or take legal action if you violate these Terms, create risk for us or others, or where required by law. We will give notice where practicable unless immediate action is needed for safety, security, or legal reasons. Provisions that should survive (licenses for residual copies, disclaimers, liability limits, indemnity, dispute terms) survive termination.

8. Camera and scanning

Camera features require your permission. You are responsible for images you capture and your right to submit them. Do not use scanning in a way that infringes third-party rights.

9. Intellectual property

The Services, branding, and software are owned by Poketerminal or licensors. Do not copy, modify, distribute, sell, or reverse engineer them except as permitted by law.

Poketerminal is independent and not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, GAME FREAK, Creatures Inc., Wizards of the Coast, or other rights holders. Pokémon and related marks are trademarks of their respective owners. Catalog images and assets remain property of their owners; the Services do not grant you a license to reproduce third-party materials except as permitted by law or those owners' terms.

10. Third parties and market data

The Services integrate third-party APIs, maps, stores, and data sources under their own terms. We are not responsible for their availability, errors, or delays.

References to marketplaces (for example eBay, TCGplayer, Fanatics Collect), grading companies (for example PSA, BGS, CGC, TAG, SGC), or similar names are for identification only. Poketerminal is not affiliated with those companies. Guide values and charts are estimates for research and negotiation, refreshed on a schedule, not offers to buy or sell.

11. Subscriptions and billing

Paid plans bill through Apple App Store, Google Play, or other checkout we specify. Free tiers and dev builds may differ from production entitlements.

Trials. Some yearly plans include a free trial (about two weeks), as shown at purchase; monthly plans usually do not. One free trial per membership tier group (Lite, Pro, or Vendor). Cancel in store settings anytime; access continues until the trial ends, then renews or ends per the store.

Refunds. Apple and Google process payment, renewals, and refunds. Subscriptions auto-renew unless you cancel before the renewal date in store settings. Digital subscriptions are not sold with a physical-goods return window. Refund requests for store purchases go through the store's refund flow; we do not control those decisions. Direct purchases outside the stores will show refund terms at checkout.

12. Disclaimers and liability

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OPERATION OR THAT MARKET DATA OR THIRD-PARTY CONTENT IS ACCURATE OR COMPLETE.

TO THE FULLEST EXTENT PERMITTED BY LAW, POKETERMINAL AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES OR ANY INTERACTIONS OR TRANSACTIONS WITH OTHER USERS OR THIRD PARTIES (INCLUDING DISPUTES OVER AUTHENTICITY, CONDITION, DELIVERY, PAYMENT, OR PERFORMANCE), EVEN IF ADVISED OF THE POSSIBILITY.

OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the maximum extent permitted.

13. Indemnity

You will defend, indemnify, and hold harmless Poketerminal and its affiliates, officers, directors, employees, and agents from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Services, your violation of these Terms, or your dealings with other users or third parties.

14. Governing law and disputes

These Terms are governed by California law, without regard to conflict-of-law principles, except mandatory consumer protections where you live may also apply. Except where prohibited, disputes will be brought exclusively in state or federal courts in San Francisco County, California, and you consent to jurisdiction there. You waive any right to participate in a class-action lawsuit or class-wide arbitration against Poketerminal where enforceable.

If you are a consumer in a jurisdiction that does not permit forum selection or class waivers, those parts may not apply to you.

15. General

  • Assignment. You may not assign these Terms without our consent. We may assign them in a merger, acquisition, or asset sale.
  • Notices. Via the Services, your Account email, or the Website.
  • Entire agreement. These Terms and the Privacy Policy are the full agreement (plus purchase terms shown at checkout where applicable).
  • Severability. Invalid provisions do not affect the rest.
